Background Empirical studies of surrogate decision-making tend to assume that surrogates should make only a 'substituted judgement'—that is, judge what the patient would want if they were mentally competent. Objectives To explore what people want in a surrogate decision-maker whom they themselves select and to test the assumption that people want their chosen surrogate to make only a substituted judgement. Methods 30 undergraduate students were recruited. They were presented with a hypothetical scenario about their expected loss of mental capacity in (...) the future and asked to answer some questions about their choice of surrogate. These data were analysed qualitatively using thematic content analysis. Results Most respondents talked about choosing someone who was caring and competent in certain ways, giving interesting evidence for their judgements. Surprisingly few highlighted how well they thought their chosen surrogate knew their preferences and would be able to make a substituted judgement. Moreover, few specified that their chosen surrogate had similar attitudes and values to their own and so would make a similar decision to theirs in the circumstances presented. Some respondents also referred to the social role of their chosen surrogate or the social dynamics of their situation which influenced their choices, as well as to ideas of reciprocity and characteristics of honesty and loyalty. Conclusion In the event that they lose mental capacity, many people will not select a surrogate to decide about medical treatments on their behalf solely on the basis that they expect their surrogate to make a substituted judgement. We are apt to wonder how a good God could possibly permit the many and frightful evils which infest the world. Aquinas, however, believed that all human beings are afflicted with "a terminal cancer of soul," for which pain and suffering are the (...) divinely-appointed remedies (340). If we are not cured, we will lose for ever the ultimate bliss of communion with God. At this rate we are to expect that the best people are precisely those who are liable to suffer the most (342). Aquinas would agree with Pope Gregory, who says that it is frequently difficult to understand the ways of providence, but never more so than "when things go ill with good people and well with bad people" (343). Stump concludes that what Aquinas's interpretation of Job, and his overall account of evil, has to show us is "that our approach to the problem of evil is a consequence of our attitude towards much larger issues, such as the nature of human happiness and the goal of human life" (356). The reader will have inferred that this is a remarkable volume. None of the contributions is to be sneezed at, and some are very impressive indeed. The hiddenness of God in Christ and "the relation between the Word Incarnate and human words for this Word" animate this study of Aquinas's christological epistemology; it is a study of Aquinas's understanding of "the mystery of Christ, and [of] human ways of signifying him" (1). And because "all human understanding and signification fails [sic] to reach Christ as he is," Schoot believes that all christological knowledge is primarily negative and heavily reliant on analogy (1). He applies to the names of Christ what another author (Mark Jordan) has applied to the divine names: "the surest approach to the divine is by the scrutiny of linguistic failure" (153). The structure of the book reflects these insights. In the first chapter the author stresses the negative character of christological language by reflecting upon Aquinas's use of mysterium in christology. The second chapter is an analysis of his use of "the concepts of signification, supposition, predication and reduplication," in the context of the most current knowledge of medieval grammar and logic (7). It is here that the author stresses Aquinas's strongly linguistic approach to christology, as well as the distinction between supposition ("standing for") and predication ("sig- 504 BOOK REVIEWS nification"), which will be crucial to his analysis of the hypostatic union in later chapters. In fact, "the whole of christology is built on the distinction between signification and supposition" (55). Schoot believes that Aquinas, following medieval "modist" grammarians, thought that "a fundamental parallel exists between different modes of signification, modes of understanding and modes of being" (43), and hence a linguistic approach is often a decisive entry into questions of theological (and christologiocal) epistemology and metaphysics. In this context, the author examines the distinction Aquinas made between a number of modes of signification. Chapter Three is devoted to Aquinas as a biblical theologian. His use of biblical names of Christ {over ninety in his commentary on Isaiah alone) suggests that "a large part of Aquinas' treatment of the person and life of the Word Incarnate is devoted to a discussion of names" (104), and that the fact that Christ is a mystery "is rooted in (his] being the 'name' of God" (105). Schoot finds that "Aquinas employs the same rules concerning signification examining those names as he does concerning the divine names" (193). Chapter Four applies the key insights of Aquinas's "theory of supposition to the theology of Christ incarnate" (194). continent. 1.2 (2011): 129-135. Introduction Vincent W.J. van Gerven Oei Successions of words are so agreeable. It is about this. —Gertrude Stein Nachoem Wijnberg (1961) is a Dutch poet and novelist. He also a professor of cultural entrepreneurship and management at the Business School of the University of Amsterdam. Since 1989, he has published thirteen volumes of poetry and four novels, which, in my opinion mark a high point in Dutch contemporary literature. His novels even more than his poetry are (...) criticized for being inaccessible, which I generally take to be a compliment. It would be like saying that Fernando Pessoa is inaccessible, which he is not. Neither is Wijnberg. When we think of the combination economist-poet we are immediately reminded of the American poet Wallace Stevens, who, as the story goes, had two stacks of paper on his desk, one for contracts, one for poems. We also know that Stevens wrote on the economy and that questions of economy and insurance surface at multiple points in his poems. The following text is a very preliminary attempt to point at the intersections between poems, novels, business, and poetry in Wijnberg’s work. On the back cover of his novel De opvolging ( The Succession , 2005), Wijnberg states the following: “[This is] a novel for whomever is interested in the workings of a company as much as in the workings of a poem.” Wijnberg thus claims that the way in which a company “works” may be similar to the way in which a poem “works.” The question is the obvious one, what does this similarity consist in? De opvolging tells the story of company in which bosses and company doctors, secretaries, children, clowns, and beggars have tons of meetings, recite poems, perform plays, tell jokes, and succeed each other, climbing up and down in the company’s hierarchy. De opvolging is a novel in which the career of people follows the career of words. It resonates with Gertrude Stein's sentences, "Grammar. What is it. Who was it" (1975, 50). The words in Wijnberg's poems are like he characters in his novel. And if we keep in mind this allegorical reading of De opvolging , which is obviously only one of the possible readings, we may be able to understand some aspects of Wijnberg’s poetry. A repetition is already a pun. Look, that word is trying it again, as if it is afraid that by not doing it it would give up the hope that it will ever be able to do something. A pun is the opposite of the first word coming to the mind of someone who shouts it when he suddenly discovers something. (104) The repetition, the succession of the same word, is already a pun, a joke. The succession of the father by the son after the revolution is a joke. "Look he's trying it again!" The essence of a joke is a repetition. Archimedes’ “Eureka!” is its opposite. Poems can easily become jokes, depending on the way the words follow and repeat each other. In De opvolging , the careers of the bosses, good and bad secretaries, and company doctors easily become jokes, as they are “afraid that by not doing it [they] would give up the hope that [they] will ever be able to do something.” Not only the repetition, but also the distance and difference between the words in a poem, their cause and effect relations can be read as company relations. This becomes clear when we, for example, read the first lines of the poem “Cause, sign” from Het leven van ( The Life Of , 2009). A sign lets know what is going to happen, a cause lets it happen. If the sign also lets happen there is no reason to isolate it, because then I would isolate some- thing only because it’s different for me. If I didn’t have to write this myself, but would have secretaries to whom I could dictate it, I would be able to say more about it. (49) Upon reading the first two lines we can already conclude that any word may be cause or sign or both. If a sign is also a cause there is no reason to discriminate it, yet to the poet they are still different. This difference only becomes expressible the moment he would have a secretary. Just like in De opvolging , the secretary introduces a distance; not in a company but in a poem. Hence the difference between “good” and “bad” secretaries in a company, where the good secretary of one boss may be the bad secretary of another one. The more we can say about the bosses of the company, or signifiers of the poem, the greater the distance we introduce between them and us. We should take serious the relation between Wijnberg’s novels and poems. Although they operate on different scales, they explain and converse with each other. Another example may be the novel Politiek en liefde ( Politics and Love , 2002), which deals with the relation, precisely, between politics and love. In the novel, Nicolai, a lieutenant in the Dutch army, is sent to Africa on a military mission. Upon leaving a receives a letter from his father. Dear son, Don’t do anything stupid before your father has advised you to do so. Your mother asked me to write a wise letter. I have been looking for wisdom for half a day and haven’t found much. If you borrow a small amount from a bank you become the bank’s slave, but if you borrow a couple of millions and spend them as quickly as possible the bank becomes your slave. What I want to say is that you have to return from Africa in good health, and before you know it the world will be your slave [....] Signed with a kiss from your father. (88) The line, “If you borrow a small amount from a bank you become the bank’s slave, but if you borrow a couple of millions and spend them as quickly as possible the bank becomes your slave,” returns as the title of poem in Het leven van: “If I borrow enough money the bank becomes my slave” (12-3), which elaborates this theme. So both in the way that these poems are structured and in their subject matter, they refer to the structures of our economy, to the ever-continuing line of CEOs succeeding each other like words, to the distance between them introduced by bureaucracy, and giving and receiving as economical and poetical acts. Poem and economy map onto each other, as in another episode from De opvolging : Edward reads two of the beggar’s poems about presents. Of a holiday nothing remains, except for memories, and if some of them are bad I’d rather forget them all; if I get a present I’d rather get something that’s useful to me for a long time. If I may choose, I choose what I can use longest, long enough to partially forget that this was the present, because it feels bad when nothing is left of it. […] Giving away becomes destruction in the stock destruction economy [ voorraadvernie -tigings-economie ], that is a gift economy [ geschenkeneconomie ], encountering for the first time an economy in which there’s selling and buying on markets. Instead of destroying supplies someone can also quickly say that they aren’t worth anything anymore; if someone wants to take them I’d gladly give him something extra. In a stock destruction economy he is someone who each day wants to work more hours than his colleagues. If around a company there is a gift economy in which someone’s rank is determined and made visible by the gifts someone can give someone else, a company will be more often character- ized by an invisible or unclear system of ranks. (152) Two poems about gifts present two different economical models, described by Wijnberg with the terms “stock destruction economy” and “gift economy.” Here we immediately recall the opposition introduced by George Bataille’s work on the concept of expenditure in The Accursed Share , where a “general economy” would surpass the stock destruction economy based on scarcity (capitalism) and become a gift economy (potlatch) and an egalitarian (communist) society. These claims are made both on the level of the poems and in their discursive explanation. They follow each other and on each other. I would like to finish this introduction to Wijnberg’s writing with a translation from his novel De joden ( The Jews , 1999), which develops the story of Hitler abdicating as chancellor of the Third Reich, appointing philosopher Martin Heidegger as his successor. In a conversation with two Russian actor-spies, sent by Stalin to figure out the situation, philosopher Walter Benjamin describes the abdication scene. Maimon: You were there when Hitler resigned? Benjamin: In the room we’re right now. The desk and the chairs are new. After his resignation Hitler would like to take his furniture to his new house. Martin naturally agrees. It is a sunny day. Martin is very nervous and complains about the heat. Martin is wearing his best dark blue suit, not his professor’s robe. Hitler is wearing his uniform. We enter the room and Hitler gets up and embraces Martin. Martin is not very good at embracing. Hitler shakes his hand. Hitler’s cap is on the desk. The cap has a metal lining. Hitler has strong neck muscles. Hitler says: A man is unclean. He takes a bath. Does he make the bath water unclean? I say: a man is unclean. He steps into a river. A little further a man steps into the river; does he become unclean? Hitler nods. I say: a man is standing in music. Another man hears the music but also sees the first man moving on the beat of the music in a way that he is certain that the music would excite different feelings in him if he wouldn’t to see the first man. Hitler says: a man is clean, listens to music, is suddenly touched and he doesn’t know by what. The conversation ends in the way you know it ends. Hitler picks up his cap from the desk and puts it on Martin’s head. (73-4) Aware of the never ending debate on the question of Heidegger’s involvement in the Nazi regime, Wijnberg has the audacity to present the arguments of complicity in the religious terminology of cleanliness and uncleanliness, while at the same time recalling overtones of Hitler’s supposed love for Wagner, suggesting a relation between Benjamin and Hitler, and so on. The space of this introduction is to small to treat a novel like De joden , a reading of which together with passages from Philippe Lacoue-Labarthe's Heidegger, Art, and Politics: The Fiction of the Political , Jacques Derrida's Of Spirit , Christopher Fynsk's Heidegger: Thought and Historicity , and Avital Ronell's The Telephone Book would be extremely elucidating and potentially open new avenues in thinking Heidegger's emphasis on poetry after the fall of the Nazi empire. But at this point we will have to curb our curiosity and follow the poet himself. The themes of the relation between business and poetry, but also Chinese landscape painting, love, Indian and Japanese poetry, and Western philosophy are analyzed and assimilated in Wijnberg’s work without ever losing the clarity of expression. It may be that, according to Alain Badiou, the “Age of the Poets” is over, but its end (Paul Celan) has exactly brought a new balance between philosophy and poetry, and it is this playful, but nonetheless serious balance that makes one hope that one day Wijnberg’s complete oeuvre might become available to readers across the planet. What I make when there’s no work left for me, I’m ashamed to say how little it is. Once I’m outside I check it, if they watch out of the window they can see me doing it. Suppose it is so much that I’d stay counting for hours, it’s getting dark and I’m still there. They stay watching for a while once they’ve finished their work, but have to go home, I get that, sure, I could also go home and continue counting there. If it’s too little running back immediately won’t help, because nobody’s there anymore, and if I come back tomorrow I may have spent what’s missing tonight. Going somewhere where it’s warm enough to walk around without clothes during daytime, it helps me to know that something’s more there than here. For someone like me there’s work anywhere, it shouldn’t take a week to find work for me there. Three times work and a home close to work, I may choose one and try for a week whether I want to stay there. If at the end of the week I don’t want to stay I’m back on the next day, then it was a week’s holiday. RULES If that’s against a rule, it’s yet another one that I cannot observe, or only so briefly that I cannot re- member it later. In the famous Correspondence with Clarke, which took place during the last year of Leibniz's life, Leibniz advanced several arguments purporting to refute the absolute theory of space and time that was held by Newton and his followers. The main aim of this book is to reassess Leibniz's attack on the Newtonian theory in so far as he relied on the principle of the identity of indiscernibles. Biobanks hold out the prospect of significant public and private benefit, as genetic information contained in tissue samples is mined for information. However, the storing of human tissue samples and genetic information for research and/or therapeutic purposes raises a number of serious privacy and autonomy concerns. These concerns are compounded when one considers the possibility that a biobank or its owner might go bankrupt. Insolvency impairs the ability of enforcement regimes, and liability-based regimes in particular, to enforce legal norms. The (...) goal of this essay is to develop guideposts for thinking about private and public enforcement of privacy imposed by donors on tissue samples and/or genetic information when a biobank becomes insolvent. Drawing on rare sources, many of which have not previously been translated into English, the view of Piaget and his work that emerges in this book is very different from the atheistic view of Piaget that is commonly held in psychology and transpersonal psychology. In both his early and later career Piaget held to an evolutionary view of spirituality reminiscent of the work of Hegel and Bergson. The spiritual future could be precursed by the individual in this life through the (...) experience of "Immanence."Piaget underwent a spiritual emergency in adolescence, reported in early autobiographical writing, in which he encountered an array of experiences described in Eastern and Western mystical cannons. For reasons discussed in this book, Piaget attempted to conceal his spiritual inclinations while tacitly confirming them in informal exchanges. This book not only describes the spiritual aspects of Piaget's life and work, it also builds bridges to both the contemporary transpersonal project and to contemporary psychology, by extending Piaget's own ideas to shed new light on transpersonal psychology and transpersonal philosophy, and on the future orientation of general psychology. The book validates the transpersonal project by showing its concerns to be germane to psychology's most influential figure. The term, “bioethics” was coined in 1970 by American cancerologist V. R. Potter. In the few decades since, the field of bioethics has emerged as an important discipline. The field has attained a remarkable degree of public recognition in a relatively short period of time. The “right to die” cases such as In re Quinlan placed bioethical issues on the front pages. Although the discipline is of recent vintage, the past quarter century has witnessed a flurry of scholarly activity, creating (...) a substantial body of bioethical literature. Moreover, the bioethics movement has manifested itself in institutional expressions. Universities and medical schools have added courses in bioethics to their curricula. In 1974, federal legislation and regulations mandated that federal grantees conducting human subjects research establish institutional review boards to safeguard subjects’ welfare, and even absent a legislative mandate numerous hospitals created ethics committees. Standard models of concept learning generally focus on deriving statistical properties of a category based on data (i.e., category members and the features that describe them) but fail to give appropriate weight to the contact between people's intuitive theories and these data. Two experiments explored the role of people's prior knowledge or intuitive theories on category learning by manipulating the labels associated with the category. Learning differed dramatically when categories of children's drawings were meaningfully labeled (e.g., “done by creative children”) (...) compared to when they were labeled in a neutral manner. When categories are meaningfully labeled, people bring intuitive theories to the learning context. Learning then involves a process in which people search for evidence in the data that supports abstract features or hypotheses that have been activated by the intuitive theories. In contrast, when categories are labeled in a neutral manner, people search for simple features that distinguish one category from another. Importantly, the final study suggests that learning involves an interaction of people's intuitive theories with data, in which theories and data mutually influence each other. The results strongly suggest that straight‐forward, relatively modular ways of incorporating prior knowledge into models of category learning are inadequate. More telling, the results suggest that standard models may have fundamental limitations. We outline a speculative model of learning in which the interaction of theory and data is tightly coupled. The article concludes by comparing the results to recent artificial intelligence systems that use prior knowledge during learning. (shrink)

In mid-Victorian Britain, reconciling elite mathematical expertise with practical mechanical experience presented both engineering and social challenges. Nowhere was this more apparent than in the construction of the Westminster Clock at Britain’s Houses of Parliament. Realizing this scheme engendered the collaboration between Cambridge mathematicians George Biddell Airy and Edmund Beckett Denison, and the clockmaker Edward John Dent. Transforming theoretical mathematical drawings into physical apparatus challenged existing relations between conveyors of privileged scientific knowledge and those with practical experience of what (...) was, and what was not, mechanically possible. My article demonstrates how, within this project, physical models and devices provided material solutions to ambiguities over authority and social disorder in Victorian Britain. (shrink)

In Daubert v. Merrell Dow Pharmaceuticals, Inc., the U.S. Supreme Court made its first major pronouncement on the evaluation of scientific evidence, calling on judges to act as gatekeepers for scientific knowledge and validity, despite lack of scientific training among judges. Daubert offers the science studies community a case study for examining how judges engage in boundary-work and construct scientific validity. In constructing scientific validity under Daubert, judges must evaluate the scientific method behind a particular scientific claim, and will look (...) to the parties' experts and the relevant scientific community for assistance. To combat the oft-cited problem of the battle of the experts, judges may be tempted to obtain assistance from court-appointed neutral experts, an inquisitorial system in the civil law tradition of many European countries. The judicial evaluation of scientific evidence, the resulting construction of scientific validity, and the push for a greater use of court-appointed experts reveal judges' desire to segregate "objective" scientific facts from aspects of the legal process that are infused with adversaries' values. Yet the scientific and judicial construction of validity mixes empirical results and research methods with the personal, political, and institutional values of judges and scientists. (shrink)

This case study examines five dimensions of the 2007–2009 financial crisis in the United States: the devastating effects of the financial crisis on the U.S. economy, including unparalleled unemployment, massive declines in gross domestic product, and the prolonged mortgage foreclosure crisis; the multiple causes of the financial crisis and panic, such as the housing and bond bubbles, excessive leverage, lax financial regulation, disgraceful banking practices, and abysmal rating agency performance; the extraordinary efforts of the Federal Reserve, the Federal Reserve Bank (...) of New York, and the Department of the Treasury to stem the financial freefall triggered by the crisis and resuscitate financial institutions, the ethical implications of the unprecedented actions by government institutions to rescue financial institutions and drag the country back from the brink of global financial collapse, and the conduct of the various parties contributing to the financial crisis, such as the shoddy behavior of mortgage brokers, the massive securitization of mortgages into overly complex bonds, the excessive leverage of financial institutions, the disgraceful work of bond rating firms, the abysmal risk management systems employed by financial institutions, and the massive operations of the shadow banking and over-the-counter derivatives markets; and the major provisions of the Dodd–Frank Wall Street Reform and Consumer Protection Act signed into law to in response to the financial crisis and for the purpose of correcting the egregious conduct of major financial institutions. This collection of essays is designed to illustrate the variety, complexity and power of non-neoclassical economic thinking. The essays define the fundamental questions differently, employ different analytical tools and arrive at different conclusions. The two strands of non-neoclassical thinking that occupy most of the book are the neo-Keynesian and the neo-Marxian. The bulk of the book is composed of essays on microeconomics, macroeconomics, trade, comparative systems and welfare, with an unusual section on property rights and social hierarchy.

For the last century, economic analysis has been wedded to the idea of equilibrium, in spite of the evident fact that most economic relationships are in flux. The theory of transformational growth in this work replaces equilibrium with history. The role of the market is not to allocate resources, but to generate innovations, which are 'selected' by competition in an evolutionary process. These innovations in turn change the way markets work and how they adjust, thus creating new problems and new (...) kinds of pressures to innovate. Different historical periods can be distinguished with a new one perhaps on the horizon. Britain's nineteenth-century railway companies traditionally play a central role in histories of the spread of standard Greenwich time. This relationship at once seems to embody a productive relationship between science and capitalism, with regulated time essential to the formation of a disciplined industrial economy. In this narrative, it is not the state, but capitalistic private commerce which fashioned a national time system. However, as this article demonstrates, the collaboration between railway companies and the Royal Greenwich Observatory was far from harmonious. (...) While railways did employ the accurate time the observatory provided, they were also more than happy to compromise the astronomical institution's ability to take the accurate celestial observations that such time depended on. Observing astronomical transits required the use of troughs of mercury to reflect images of stars, but the construction of a railway too near to the observatory threatened to cause vibrations which would make such readings impossible. Through debates over proposed railway lines near the observatory, it becomes clear how important government protection from private interests was to preserving astronomical standards. This article revises our understanding of the role of railway companies in the dissemination of standard time and argues that state intervention was essential to preserving Victorian British astronomical science.
